The Gemora states that Rabbi Bana’ah used to mark out caves and it relates what happened when he went into the Cave of Machpeilah (where the Patriarchs and Matriarchs were buried).



The Rashbam explains that he did this in order to determine the precise dimensions of the crypts, and after marking its borders on the ground above, people, and especially Kohanim, would be able to avoid becoming tamei (through tumas ohel – forming a tent over a corpse).

The Poskim deal with when do we say the law of the land is binding. Rav Moshe Feinstien was asked about a bankruptcy case. One of the creditors had taken the money he was owed. This was against the law, for the company was protected under bankruptcy laws. On the other hand, according, to Torah law, he was entitled to the money.

The Gemora concludes that the words “toshav v’sachir” mentioned in

respect to the Pesach offering are extra. What does “toshav v’sachir”

mean when it is written here? It cannot be referring to the two types

of Jewish servants (a Jewish servant who is acquired for an acquisition

Shmuel once said to Rav Chana Bagdasaah (from Baghdath, or an Aggada

expert), “Go out and bring me ten people (so that the ruling should be

publicized) in order for me to say to you before them that one who

gives something to a fetus, the fetus has acquired it.”



It would seem form this Gemora that if something should be publicized, ten people are required.

It is clear from the mishneh in gitin that two people are not public but three people are public, i.e. that if he makes some sort of declaration it will become known generally. The public you are referring to is pharhasia which is 10 people. This requires 10 kosher jews.
